Terms of Use

The agreement between you and Discretion

Effective 4 July 2026

These Terms of Use govern your access to and use of the Discretion platform, including our website, applications, and services. By creating an account or using the Platform you agree to these Terms. If you do not agree, you must not use the Platform.

1.About Discretion

The Platform is owned and operated by Discretion Management Limited ("Discretion", "the Platform", "we", "us", or "our"), a company incorporated and registered in England and Wales, United Kingdom. Discretion operates an online platform for verified companions, creators, agencies, studios, clients, affiliates, and industry professionals. The Platform offers profiles, bookings, tipping, private galleries, a content feed with subscriptions and pay-per-view purchases, custom content, live cam and private shows with interactive features, an adult industry job board, and an affiliate programme.

These Terms of Use apply together with our other policies, each of which forms part of your agreement with us where it is relevant to how you use the Platform. These include the Privacy Policy, the Acceptable Use Policy, the Community Guidelines, the Age Verification Policy, the Content Moderation Policy, the Refund and Diamonds Policy, the Companion and Creator Agreement, the Live Streaming, Cam and Interactive Services Policy, and the Affiliate Programme Terms. Where a specific policy applies to an activity, that policy applies in addition to these Terms.

2.Company Details and Legal Compliance

The Platform is owned and operated by Discretion Management Limited, a company incorporated and registered in England and Wales, United Kingdom, with company number 14534456 and registered office at 14-15 Harelands Courtyard Offices, Moor Road, Melsonby, Richmond, North Yorkshire, DL10 5NY, United Kingdom. You can contact us on any legal, regulatory, or compliance matter at info@discretion.vip.

We operate the Platform in accordance with applicable law and maintain a suite of compliance policies which form part of these Terms. These include:

  • Age Verification Policy: every user is identity and age verified as 18 or over before they can transact, in line with the UK Online Safety Act 2023 and equivalent requirements in the jurisdictions in which we operate.
  • Content Moderation Policy and Community Guidelines: proactive and reactive moderation of all content published or sold on the Platform.
  • Child Protection Policy: zero tolerance of child sexual abuse material, with reporting to the National Crime Agency, CEOP, the Internet Watch Foundation, and equivalent authorities.
  • Complaints and Content Takedown Policy: a route for anyone, including persons depicted in content, to report and have removed non-consensual, infringing, or manipulated (deepfake) material.
  • Privacy Policy and Data Retention Policy: personal data is processed in accordance with the UK GDPR and the Data Protection Act 2018.
  • Anti-money-laundering and know-your-customer checks on payouts and higher-value or higher-velocity activity, and cooperation with our payment partners on transaction monitoring.
  • Law Enforcement Disclosure Policy: cooperation with lawful requests from competent authorities.

Payments are handled by our third-party payment providers. Card and payment credentials are processed by those providers in accordance with the Payment Card Industry Data Security Standard (PCI DSS); we do not store full card details on our own systems.

3.Eligibility

You must be at least 18 years old and legally permitted to access adult content and services in your jurisdiction.

  • You must provide accurate registration information and keep it current.
  • You must not have been previously banned or suspended.
  • You must have legal capacity to enter into this agreement.
  • You must not access the Platform on behalf of anyone who does not meet these requirements.

We may refuse or terminate access where we reasonably believe eligibility is not met.

4.Accounts and Security

You are responsible for your account, your login credentials, and all activity under your account. You must keep your password confidential and enable available security features such as two factor authentication. Notify us immediately of any unauthorised use.

Your account type (for example client, companion, creator, agency, job seeker, or job poster) is selected at sign up and reflects how you use the Platform. We may verify your role and restrict features that do not match your account type.

5.Verification

Companions, creators, and any user who publishes a public profile, uploads adult content, or withdraws funds must complete age and identity verification through our provider before those features are enabled. We may require re-verification at any time. Full detail is set out in our Age Verification Policy.

6.The Diamond System

The Platform uses diamonds, a prepaid digital balance, to pay for digital features and services such as gallery unlocks, tips, content purchases, placements, job postings, and, where offered, live content. Diamonds are purchased through our payment provider and are denominated in pounds sterling.

Diamonds pay only for digital features and services on the Platform. Diamonds are not, and must not be used as, payment for companionship, a person's time, meetings, dates, or any in-person services. Any arrangement between users for companionship or in-person services is made directly between independent adults, is not facilitated, processed, priced, or charged by Discretion, and Discretion is not a party to it and takes no commission from it.

  • Diamonds are a limited-use digital balance for use within the Platform. They are not legal tender, electronic money usable elsewhere, or a deposit, and they carry no interest.
  • The price to purchase diamonds and the value at which eligible users may withdraw earned diamonds are set out in the Platform and in the Refund and Diamonds Policy.
  • Eligible earners may request withdrawal of earned diamonds subject to a minimum threshold, identity verification, and a holding period before release.
  • We may adjust pricing and features on reasonable notice.

7.Pricing, Tax, and VAT

Prices are shown in pounds sterling and include VAT or equivalent sales tax where applicable. Where the law of your jurisdiction requires tax to be charged or accounted for on digital services, we will apply it in accordance with that law. You are responsible for declaring and paying any tax due on your own earnings.

8.Acceptable Use

You agree to use the Platform lawfully and in line with our Acceptable Use Policy and Community Guidelines, which form part of these Terms. Prohibited conduct includes illegal content, content involving anyone under 18, non-consensual content, harassment, fraud, and circumventing safety or payment systems.

9.User Content and Consent

You retain ownership of content you upload. You grant Discretion a worldwide, non-exclusive, royalty free licence to host, store, watermark, reproduce, and display it for the purpose of operating, securing, and promoting the Platform.

You must own or have the rights to all content you upload, and you must have the verifiable consent of every person depicted, confirming they appear in it, are 18 or over, and agree to its publication and sale. We record and retain consent as described in the Content Moderation Policy.

10.Content Moderation

All content is subject to automated screening and human review. We may remove or restrict content, suspend accounts, and report unlawful material to the authorities, as set out in the Content Moderation Policy and the Child Protection and Anti-Exploitation Policy.

11.Bookings and Conduct Between Users

Discretion provides tools to connect users. We are not a party to arrangements made between users and do not employ companions or creators. Users are independent and responsible for their own conduct, tax, and legal compliance.

Any payment for companionship or in-person services is arranged and made directly between users as independent adults. Discretion does not process, price, or take any fee from such payments, and diamonds cannot be used for them.

All interactions must be lawful and consensual and must comply with the law in the relevant jurisdiction.

12.Reviews and Ratings

Reviews must be honest, based on genuine experience, and must not contain unlawful, defamatory, or personally identifying information. We may moderate or remove reviews that breach these Terms.

13.Intellectual Property

The Platform, its branding, and its software are owned by Discretion or its licensors and are protected by intellectual property law. You may not copy, scrape, reverse engineer, or exploit any part of the Platform except as expressly permitted.

14.Payouts

Earnings are paid in diamonds and may be withdrawn by eligible verified users at the published withdrawal value, after the platform fee, subject to the holding period and minimum threshold set out in the Refund and Diamonds Policy.

15.Suspension and Termination

You may close your account at any time. We may suspend or terminate access where you breach these Terms, where required by law, or to protect users or the Platform. On termination, your right to use the Platform ends, although certain records (including consent and transaction records) are retained as required by law.

16.Disclaimers

The Platform is provided on an as available basis. To the extent permitted by law, and without affecting your statutory rights, we exclude implied warranties. We do not guarantee uninterrupted or error free operation, or the conduct of any user.

17.Limitation of Liability

Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud, or for any matter for which it would be unlawful to limit liability, and nothing affects your non-excludable consumer rights.

Subject to the above, to the maximum extent permitted by law: we are not liable for indirect or consequential loss, loss of profit, loss of data, or loss arising from interactions between users; and our total aggregate liability arising out of or in connection with the Platform is limited to the greater of the total amounts you paid to us in the 12 months before the event giving rise to the claim, or one hundred pounds (GBP 100).

18.Indemnity

You agree to indemnify Discretion against claims, losses, and reasonable costs arising from your breach of these Terms, your content, or your unlawful use of the Platform. This does not apply to the extent a loss results from our own breach or negligence, and does not apply to you as a consumer beyond what the law permits.

19.Governing Law and Jurisdiction

These Terms and your use of the Platform are governed by the laws of England and Wales, United Kingdom. Discretion Management Limited is incorporated and registered in England and Wales. Subject to the consumer protections below, the courts of England and Wales have exclusive jurisdiction over any dispute.

If you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in your local courts. If you are resident in Australia, these Terms are read subject to the Australian Consumer Law and other mandatory laws of the Commonwealth of Australia and your state or territory, and nothing in these Terms excludes rights that cannot lawfully be excluded.

20.Your Statutory and Consumer Rights

Nothing in these documents affects your non-excludable statutory rights as a consumer.

United Kingdom

Where you are a consumer in the UK, you have rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Digital content supplied through the Platform must be as described, fit for purpose, and of satisfactory quality.

Right to cancel and digital content

Where a statutory cancellation period applies, you may have up to 14 days to cancel certain purchases. By purchasing and using diamonds or accessing digital content immediately, you request immediate supply and acknowledge that your right to cancel is lost once supply has begun, to the extent permitted by law.

Australia

Where you are a consumer in Australia, our services come with guarantees that cannot be excluded under the Australian Consumer Law, including remedies for failures that amount to a major failure.

21.General Provisions

Entire agreement

These documents, together with any policies referenced in them, form the entire agreement between you and Discretion regarding the Platform and supersede any prior arrangements.

Severance

If any provision is found to be unenforceable, the remaining provisions continue in full force, and the unenforceable provision is modified to the minimum extent necessary to make it enforceable.

Waiver

A failure to enforce any right or provision is not a waiver of that right or provision.

Assignment

You may not assign or transfer your rights or obligations without our consent. We may assign our rights and obligations, including in connection with a merger, acquisition, or sale of assets, without affecting your rights.

Third party rights

Except where stated, a person who is not a party to these documents has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term.

Force majeure

We are not liable for any failure or delay caused by events beyond our reasonable control, including outages, failures of third party providers, or acts of government.

We may give notice to you by email or through the Platform. You may contact us at info@discretion.vip.

Dispute resolution

If a dispute arises, please contact us first at info@discretion.vip so we can try to resolve it. If we cannot resolve it, the dispute may be referred to the courts identified in the Governing Law and Jurisdiction section. Where alternative dispute resolution applies to you as a consumer, we will tell you about the relevant scheme.

Changes

We may update these documents from time to time. We will notify registered users of material changes, and the effective date shows the latest revision. Continued use after changes take effect constitutes acceptance.
