This Agreement applies to companions, creators, and performers who use Discretion to publish profiles, sell content, or earn through the Platform. It supplements the Terms of Use.
1.Independent Status
You are an independent user, not an employee, worker, or agent of Discretion. You control your profile, content, services, availability, and pricing. You are responsible for your own legal, tax, and regulatory compliance.
2.Verification
Before publishing or withdrawing, you must complete age and identity verification (18 or over). You must keep verification current and re-verify on request.
3.Your Content and Consent
- You must own or have the rights to all content you upload.
- Solo content must genuinely depict you.
- For content featuring anyone else, every person must be a verified adult who has given recorded consent to appear and to publication and sale.
- You grant Discretion a licence to host, store, watermark, display, and distribute your content to operate and promote the Platform.
4.Earnings and Payouts
You earn diamonds from eligible digital activity on the Platform (such as tips, gallery and content unlocks, and content sales) and may withdraw at the published withdrawal value, after the platform fee, subject to the minimum threshold, verification, and holding period.
Diamonds and Platform earnings relate only to digital features and services. They are not payment for companionship or in-person services. Any arrangement you make directly with another user for companionship or in-person services is between you and that user as independent adults, off platform, and Discretion is not a party to it and takes no commission from it.
5.Conduct
You must act lawfully and professionally, honour the Community Guidelines, and not engage in prohibited conduct. You must not feature non-consenting people or anyone under 18 in any content.
6.Content Removal and Suspension
We may remove content or suspend your account where content or conduct breaches our policies. Consent records are retained as required by law even after content or account removal.
7.Intellectual Property
You retain ownership of your content. You are responsible for protecting your own rights, and we provide tools such as watermarking and diamond-locked galleries to help reduce misuse.
8.Termination
You may stop using the Platform at any time. We may suspend or terminate access for breach or to protect users. Certain records are retained after termination as required by law.
9.Governing Law and Jurisdiction
These Terms and your use of the Platform are governed by the laws of England and Wales, United Kingdom. Discretion Management Limited is incorporated and registered in England and Wales. Subject to the consumer protections below, the courts of England and Wales have exclusive jurisdiction over any dispute.
If you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in your local courts. If you are resident in Australia, these Terms are read subject to the Australian Consumer Law and other mandatory laws of the Commonwealth of Australia and your state or territory, and nothing in these Terms excludes rights that cannot lawfully be excluded.
10.Your Statutory and Consumer Rights
Nothing in these documents affects your non-excludable statutory rights as a consumer.
United Kingdom
Where you are a consumer in the UK, you have rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Digital content supplied through the Platform must be as described, fit for purpose, and of satisfactory quality.
Right to cancel and digital content
Where a statutory cancellation period applies, you may have up to 14 days to cancel certain purchases. By purchasing and using diamonds or accessing digital content immediately, you request immediate supply and acknowledge that your right to cancel is lost once supply has begun, to the extent permitted by law.
Australia
Where you are a consumer in Australia, our services come with guarantees that cannot be excluded under the Australian Consumer Law, including remedies for failures that amount to a major failure.
11.General Provisions
Entire agreement
These documents, together with any policies referenced in them, form the entire agreement between you and Discretion regarding the Platform and supersede any prior arrangements.
Severance
If any provision is found to be unenforceable, the remaining provisions continue in full force, and the unenforceable provision is modified to the minimum extent necessary to make it enforceable.
Waiver
A failure to enforce any right or provision is not a waiver of that right or provision.
Assignment
You may not assign or transfer your rights or obligations without our consent. We may assign our rights and obligations, including in connection with a merger, acquisition, or sale of assets, without affecting your rights.
Third party rights
Except where stated, a person who is not a party to these documents has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term.
Force majeure
We are not liable for any failure or delay caused by events beyond our reasonable control, including outages, failures of third party providers, or acts of government.
Notices
We may give notice to you by email or through the Platform. You may contact us at info@discretion.vip.
Dispute resolution
If a dispute arises, please contact us first at info@discretion.vip so we can try to resolve it. If we cannot resolve it, the dispute may be referred to the courts identified in the Governing Law and Jurisdiction section. Where alternative dispute resolution applies to you as a consumer, we will tell you about the relevant scheme.
Changes
We may update these documents from time to time. We will notify registered users of material changes, and the effective date shows the latest revision. Continued use after changes take effect constitutes acceptance.
12.Contact
For any enquiry, including support, privacy and data protection, content reports, complaints, copyright, and legal or law enforcement matters, contact info@discretion.vip. We aim to respond within a reasonable time.
13.Selling Content on the Feed
As a Creator you may post Content to your Feed and offer it as free, subscriber-only, or Pay-Per-View (PPV). You choose how each post is made available and you set the price for any paid Content, subject to the applicable platform fee shown in your dashboard. All sales of Content on the Feed are made in Diamonds.
You retain ownership of your Content. You grant Discretion a non-exclusive licence to host, store, watermark, reproduce, display, distribute, and promote your Content on and in connection with the Platform for as long as needed to operate the service and to meet our legal obligations.
- You warrant that you own or have all rights, licences, and consents needed for every element of the Content and for every person who appears in it.
- You warrant that every person shown is you or another verified adult aged 18 or over, and that you hold proof of age and recorded consent to appear, publish, and sell for each such person.
- You will keep those records and provide them to us on request, in line with the Age Verification Policy and the Content Moderation Policy.
- Your Content must comply with the Acceptable Use Policy and all applicable law of England and Wales.
14.Subscriptions
You may offer paid Subscriptions that renew on a recurring basis. You set the tiers, the benefits of each tier, and the price you charge, subject to the applicable platform fee shown in your dashboard. You must describe clearly what a Subscriber receives at each tier before they subscribe.
While a Subscription is active you must continue to deliver the value and access you have advertised for that tier. You must not remove or materially reduce advertised benefits during a paid period without notice, and you must not mislead Subscribers about what they will receive.
Cancellation, non-renewal, and any adjustment on a cancelled or lapsed Subscription are handled in line with the Refund and Diamonds Policy. A Subscriber who cancels retains access for the period already paid unless that Policy provides otherwise.
You must not solicit or move Subscribers or Fans off the Platform to avoid the applicable platform fee, and you must not share off-platform contact or payment details for that purpose.
15.Pay-Per-View and Unlocks
You may sell individual Content through Pay-Per-View (PPV) posts, locked galleries, and paid messages. A Fan pays the price you set, in Diamonds, to unlock the item. Once unlocked, the Content is digital and is delivered to the Fan immediately.
Because delivery is immediate, a PPV item, gallery unlock, or paid message is treated as non-refundable once it has been unlocked, except where the Refund and Diamonds Policy or your non-excludable statutory rights provide otherwise.
Every paid item must be described accurately before purchase. You must not use misleading previews, false descriptions, or bait to induce an unlock, and the Content delivered must match what was advertised.
16.Custom Content
You may accept commissions to produce Custom Content for a Fan. You should agree the scope, format, and price with the Fan before you begin, and you must deliver the Custom Content as described and within the timescale agreed.
All Custom Content must comply with this Agreement, the Acceptable Use Policy, and the Content Moderation Policy. You must not accept or act on any request that would breach our policies or the law of England and Wales, and you must decline any prohibited request. Declining a prohibited request is not a breach of your obligations to the Fan.
Refunds or adjustments for Custom Content are handled in line with the Refund and Diamonds Policy.
17.Live Shows and Cam
You may broadcast Live Shows and Private Shows through the Platform, subject to the Live Streaming, Cam and Interactive Services Policy. Entry fees, Tips, and any goals set during a show are voluntary payments made by Fans in Diamonds.
You control your own show. You may set its rules, decline requests, and end the broadcast at any time. Ending a show early does not by itself create a right to a refund, which is governed by the Refund and Diamonds Policy.
You remain responsible for everything shown in your stream, including anyone who appears in shot, your surroundings, and any Content displayed. Your broadcast must comply with this Agreement, the Acceptable Use Policy, and the Age Verification Policy.
18.Interactive Devices
Connecting a compatible interactive device to a Live Show or Private Show is optional and entirely under your control. You choose whether to connect a device, when to connect it, and when to disconnect it.
Where you enable a device, Fans may trigger it through Tips within the limits and settings you configure. You may change or remove those limits, and you may disable the device, at any time and without notice.
Your safety, comfort, and hygiene when using any device are your responsibility. You must follow the manufacturer's instructions and stop use if you feel unsafe or unwell. Use of interactive devices is subject to the Live Streaming, Cam and Interactive Services Policy.
19.Your Content Warranties
For all Content, Live Shows, Private Shows, and Custom Content you provide through the Platform, you warrant and undertake that:
- Every person shown is you or another verified adult aged 18 or over who has given recorded consent to appear, and you hold proof of age and consent records on file for each such person.
- The Content is genuine and unmanipulated imagery of the real person or persons depicted, and is not AI-generated, synthetic, computer-generated, face-swapped, or otherwise digitally fabricated or manipulated. Deepfakes and synthetic sexual or intimate imagery are prohibited.
- The Content and any live broadcast is lawful and complies with this Agreement, the Acceptable Use Policy, the Content Moderation Policy, and the Age Verification Policy.
- You own or hold all intellectual property rights and all release and consent rights needed to publish, sell, and distribute the Content through the Platform.
- You will provide your consent, age, and release records to us promptly on request, and you understand that certain records are retained as required by law even after removal of the Content or your account.
20.Co-Created and Duo Content
The Platform allows two or more verified Creators to work together, including by forming a duo with a shared profile, or by creating, appearing in, or publishing Content together. This section applies whenever Content, a shared profile, a Live Show, or a Private Show features, or is created by, more than one person (Co-Created Content).
A duo profile is created by one Creator, the owner, who invites another verified Creator, the partner, to join. The partner must accept the invitation before the duo becomes active. Each member of a duo, and each participant in any collaboration, is bound by this Agreement in respect of that Content, whatever their role.
- Every participant must be individually age and identity verified as an adult aged 18 or over. One participant cannot verify, or consent, on behalf of another.
- Every participant must give their own freely given, informed, and recorded consent to the specific Content being created, published, and offered for sale, before that Content goes live.
- The Creator who uploads or owns the Content must hold proof of age and recorded consent for every person who appears in it, and must provide those records to us on request.
- No person may be included in Co-Created Content, a duo, or a collaboration without their consent and proof of age, and no one may be pressured, incentivised, or misled into appearing.
Each participant is responsible for their own conduct, and all participants are jointly responsible for ensuring that Co-Created Content complies with this Agreement, the Acceptable Use Policy, the Content Moderation Policy, and the Age Verification Policy.
21.Duo Revenue Sharing, Withdrawal and Removal
Where you create or join a duo or other collaboration, you and the other participants agree a revenue share between yourselves. The agreed share is shown when the duo is set up and when a participant accepts. We apply that agreed split to distribute each participant's portion of the net earnings from the shared Content, after the applicable platform fee.
- The revenue share is a commercial arrangement between the participants. Discretion facilitates the agreed split, but is not a party to it and is not responsible for resolving disputes about how earnings should be divided between you.
- Payouts to each participant remain subject to that participant's own identity verification, any applicable holds, and the Refund and Diamonds Policy.
- Refunds, chargebacks, and reversals affecting shared Content may be adjusted against the participants in line with the agreed split.
A participant may withdraw their consent, or leave a duo, at any time by notifying us or using the tools we provide. We will act on a verified request within a reasonable period.
- On withdrawal of consent or departure, Content that features the withdrawing participant may be removed, hidden, or restricted, so that no one continues to appear in Content they no longer consent to.
- Any participant may request the removal of Content in which they appear, and we will remove or restrict it. This protects each person's right to control their own image.
- Earnings properly accrued before removal are handled according to the agreed split up to that point. Removal does not entitle any participant to reclaim sums already correctly paid to another participant, and does not by itself entitle a purchaser to a refund except as set out in the Refund and Diamonds Policy.
- A duo or collaboration may end where a participant leaves, withdraws consent, or is suspended, and we may deactivate a shared profile in those circumstances.
Disputes between co-creators about their arrangement, their revenue share, or their relationship are between the participants. Discretion is not the arbiter of those private matters, but we will always act to uphold consent, safety, age verification, and each person's control over their own image.
22.Agencies and Studios
Where you are represented by an Agency or Studio, the following applies in addition to the rest of this Agreement.
- You must personally complete your own age and identity verification. An Agency or Studio cannot complete verification on your behalf.
- You consent to your Agency or Studio managing or editing your live profile only after you have been verified and have given recorded consent to that arrangement.
- You may withdraw that consent at any time, and we will act on your withdrawal in line with our procedures.
- Your Agency or Studio must comply with this Agreement and all applicable policies when acting in relation to your account.
Any commercial terms between you and your Agency or Studio, including how your earnings are shared, are a matter between you and them. Discretion is not a party to that arrangement and is not responsible for it.
23.Earnings, Fees and Payouts
You earn Diamonds from eligible activity on the Platform, including Content sales, Subscriptions, Tips, PPV and gallery unlocks, paid messages, and Live and Private Shows. The applicable platform fee is deducted at the rate shown in your dashboard.
Diamonds you have earned may be converted to a Payout in line with the withdrawal terms and minimum thresholds shown in your dashboard, and subject to identity verification and any applicable holding period.
We may apply holds, verification checks, and adjustments to your balance or Payout to reflect chargebacks, reversals, refunds, or suspected fraud or breach. Refunds and related adjustments are handled in line with the Refund and Diamonds Policy.
24.Taxes and Independent Status
You use the Platform as a self-employed and independent person. You are not an employee, worker, or agent of Discretion, and nothing in this Agreement creates any such relationship.
You are solely responsible for your own tax affairs, including registering where required, keeping records, and reporting and paying any income tax, National Insurance, and any Value Added Tax (VAT) or other charges that apply to your earnings. Discretion does not deduct tax on your behalf and gives no tax advice. You should take your own professional advice where you need it.
