Affiliate Programme Terms

Terms for members of the Discretion affiliate programme

These Affiliate Programme Terms govern your participation in the Discretion Affiliate Programme. They form a binding agreement between you and Discretion (the Platform). By applying to join the Affiliate Programme, accepting your acceptance into it, or promoting Discretion using any Referral link or code, you confirm that you have read, understood, and agree to be bound by these terms, together with our main Terms of Use, Privacy Policy, and any operational guidance we publish in your affiliate dashboard. If you do not accept these terms, you must not participate in the Affiliate Programme.

1.About the Affiliate Programme

The Affiliate Programme allows approved participants (each an 'Affiliate') to promote Discretion and to earn Commission on qualifying activity generated by users they refer to the Platform.

As an Affiliate, you are provided with one or more unique Referral links or codes. When a Client, Companion, Creator, or other user reaches the Platform through your Referral and carries out qualifying activity, you may earn Commission at the applicable rate we publish in your affiliate dashboard.

Your participation is on the terms set out here. Nothing in the Affiliate Programme creates a partnership, joint venture, agency, or employment relationship between you and Discretion. You are an independent participant, and you have no authority to bind Discretion or to make representations on its behalf.

2.Eligibility

To join and remain in the Affiliate Programme, you must meet the following requirements at all times.

  • You are aged 18 or over and, where you act on behalf of a business, you are duly authorised to bind that business.
  • You hold your own Discretion account, and that account is in good standing and not suspended or restricted.
  • You provide accurate, current, and complete registration and payment details, and you keep them up to date.
  • You may participate as an individual or as a business, provided the relevant party accepts these terms.
  • You comply with these terms, our main Terms of Use, and all applicable laws.

We may approve or decline any application to the Affiliate Programme at our sole discretion, and we are not obliged to give reasons. Meeting the criteria above does not guarantee acceptance.

3.Your Referral Link and Attribution

On acceptance, you will be issued one or more unique Referral links or codes. You must use only the Referral links and codes assigned to your account, and you must not alter, obscure, or misrepresent them.

Attribution of a Referral is determined by the tracking and attribution rules we operate, which typically rely on cookie based, last click attribution within the attribution window shown in your affiliate dashboard. Where more than one Affiliate could claim the same user, we diamond the Referral in accordance with those published rules.

  • Each referred user may be attributed to only one Affiliate.
  • Self-referrals are not permitted. You may not use your own Referral link or code to generate Commission on your own account, spend, or activity, or that of a household member or connected person.
  • Attribution depends on the referred user's device and browser settings, which are outside our control, and we do not guarantee that any given Referral will be tracked.
  • We may adjust the attribution window and tracking method from time to time, with any change reflected in your dashboard.

4.Commission

You may earn Commission on qualifying referred spend at the rate shown in your affiliate dashboard. What counts as qualifying spend, and any excluded activity, is set out in the dashboard and may be updated from time to time.

Commission is first recorded as pending when a qualifying transaction takes place. Commission is considered earned only after the applicable holding period we publish has passed and the underlying transaction has cleared and is no longer subject to reversal.

  • Commission remains pending during the holding period shown in your dashboard, to allow for refunds, chargebacks, cancellations, and fraud checks.
  • We may adjust, reduce, or reverse Commission where the underlying spend is refunded, charged back, reversed, cancelled, or found to be fraudulent, and we may claw back Commission already paid in such cases.
  • Commission is calculated on the net value we determine, excluding taxes, refunds, Diamonds issued as goodwill or promotions, and any amounts we reasonably treat as non-qualifying.
  • We may set off any clawback or adjustment against current or future Commission owed to you.

5.Payouts

Earned Commission becomes payable once your balance reaches the minimum payout threshold and in line with the payout schedule shown in your affiliate dashboard.

  • Payouts are made using the payout methods we make available and that you select in your dashboard.
  • You are responsible for providing and maintaining correct and complete payout details. We are not liable for Commission sent to details you have provided that are incorrect or out of date.
  • We may withhold or delay any payout pending identity, tax, or anti-fraud verification, or where we reasonably suspect a breach of these terms.
  • Where Commission remains below the minimum threshold, it may be carried forward until the threshold is met.

All Commission and payout figures are stated in GBP (£) unless we state otherwise.

6.Acceptable Promotion

You may promote Discretion only through channels that you own or lawfully control and that are appropriate for adult industry advertising. Permitted channels include the following.

  • Your own website, blog, or landing pages.
  • Your own social media accounts and profiles, where the platform's rules permit adult related promotion.
  • Email or messaging to an audience that has opted in to receive marketing from you and where you hold a lawful basis to contact them.

All promotion must be honest, must accurately describe Discretion and the Platform, and must present age restricted content and services responsibly and only to appropriate audiences.

7.Prohibited Promotion

You must not engage in any of the following. Doing so is a material breach of these terms and may result in forfeiture of Commission and termination.

  • Sending spam or unsolicited messages, or contacting anyone who has not opted in to your marketing.
  • Making misleading, false, or exaggerated claims about Discretion, the Platform, Companions, Creators, earnings, or Diamonds.
  • Bidding on or using Discretion trademarks, brand terms, or confusingly similar terms in paid search, or otherwise engaging in brand bidding on paid advertising.
  • Cookie stuffing, forced clicks, hidden frames, pop unders, or any technique that sets tracking without genuine user intent.
  • Generating incentivised, fake, automated, or fraudulent sign-ups or transactions.
  • Placing adult content or Referral material in a way that breaches the rules, terms, or policies of any third party channel or advertising network.
  • Impersonating Discretion, or implying you are Discretion, an official representative, or that Discretion endorses you beyond your status as an Affiliate.
  • Promoting to persons under 18, or targeting or promoting in any jurisdiction where Discretion, adult services, or such promotion is prohibited or restricted.
  • Placing Referral material on sites containing illegal, defamatory, hateful, or infringing content, or content involving minors.

8.Compliance and Advertising Standards

You are responsible for ensuring that all your promotion complies with applicable law and industry standards. Without limitation, you must comply with the following.

  • Clearly disclose your affiliate relationship with Discretion where disclosure is required, so that your audience understands your content is an advertisement or contains Referral links.
  • Comply with the advertising codes administered by the Advertising Standards Authority (ASA) and the Committee of Advertising Practice (CAP), including rules on adult and age restricted advertising.
  • Comply with the UK GDPR, the Data Protection Act 2018, and the Privacy and Electronic Communications Regulations (PECR) in relation to any marketing you carry out.
  • Comply with the terms, policies, and community rules of any website, platform, network, or service you use to promote Discretion.

You will indemnify Discretion against any claims, penalties, or losses arising from your failure to comply with this section.

9.Intellectual Property and Brand Use

Subject to your compliance with these terms, we grant you a limited, non-exclusive, non-transferable, and revocable licence to use the Discretion name, logos, and approved marketing assets solely to promote Discretion as an Affiliate for the duration of your participation.

  • You may use only the marks and assets we approve or make available, and you must use them in the form provided.
  • You must not modify, distort, or create derivative versions of our marks or assets, except where we expressly permit resizing that preserves the original appearance.
  • You must not register, use, or attempt to register any domain name, social handle, trademark, or business name that includes or is confusingly similar to our brand.
  • You must not imply any relationship with Discretion beyond your status as an Affiliate, and you must not suggest sponsorship, partnership, or endorsement that does not exist.

All intellectual property rights in Discretion, the Platform, and our marks and assets remain owned by us or our licensors. This licence ends automatically on termination of your participation, and you must then stop all use of our marks and assets.

10.Tax

You are solely responsible for determining, reporting, and paying any taxes, duties, or similar charges arising from your Commission and your participation in the Affiliate Programme, including income tax, national insurance, and VAT where applicable.

  • Commission is stated exclusive of any VAT, unless we state otherwise. Where you are VAT registered and VAT is properly chargeable, this will be handled in accordance with the process shown in your dashboard.
  • We may require you to provide tax information, a valid VAT number, or other documentation before making or continuing payouts, and we may withhold payment until you do so.
  • We may withhold or deduct any amount required by law, and we will account for it as required.

11.Confidentiality and Data

You must keep confidential any non-public information we make available to you in connection with the Affiliate Programme, including rates, reporting data, and unreleased features, and use it only to participate in the Affiliate Programme.

  • You must handle any personal data relating to referred users or your own audience lawfully and in accordance with applicable data protection law.
  • You must not scrape, harvest, or extract data from the Platform, and you must not access data other than as we permit.
  • You must not use the Affiliate Programme, referred user data, or Platform data to build, seed, or enrich any list, database, or service that competes with Discretion, or to solicit users away from the Platform.
  • You must not sell, rent, or otherwise transfer any referred user data obtained through the Affiliate Programme.

12.Suspension and Termination

Either party may end your participation in the Affiliate Programme at any time. You may withdraw by contacting us or by closing your affiliate account. We may suspend or terminate your participation with or without notice, including where we reasonably suspect a breach of these terms or fraudulent activity.

  • On suspension, we may pause tracking and hold any pending Commission while we investigate.
  • We may withhold, reduce, or reverse Commission, including Commission already paid, where you have breached these terms or engaged in fraud, prohibited promotion, or manipulation of the Affiliate Programme.
  • On termination, your Referral links and codes will be deactivated, your licence to use our marks and assets ends, and you must cease all promotion of Discretion.
  • Subject to any withholding or clawback, we will pay validly earned Commission that has cleared the holding period and meets the minimum threshold, in accordance with the payout process.

Sections that by their nature should survive termination, including those on clawback, intellectual property, confidentiality, tax, liability, and indemnity, will continue to apply.

13.Liability and No Guarantee

We do not guarantee any level of traffic, Referrals, conversions, or earnings. Any examples or projections are illustrative only and are not a promise of results. Your earnings depend on factors within your control and on user behaviour we do not control.

The Affiliate Programme, including its tracking, reporting, and dashboard, is provided on an 'as is' and 'as available' basis. We do not warrant that tracking will be uninterrupted or error free, and we are not liable for Referrals or Commission lost due to technical issues, user settings, or third party channels.

Our liability to you in connection with the Affiliate Programme is limited as set out in our main Terms of Use. Nothing in these terms limits or excludes any liability that cannot lawfully be limited or excluded under the laws of England and Wales.

14.Changes and Contact

We may change these terms, the Commission structure, the rates, the attribution rules, and the payout arrangements from time to time. We will give notice of material changes, including by updating your affiliate dashboard or notifying you by email, and the change will take effect on the date we specify. Your continued participation after a change takes effect constitutes acceptance of the updated terms.

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them.
